Terms of Service

1. Agreement to these terms

These Terms of Service (the “Terms”) are an agreement between you and MOBGE BILISIM TEKNOLOJILERI ANONIM SIRKETI (“MobGe”, “we”, “us” or “our”). They apply to the mobile games that MobGe publishes, including on Google Play under the developer name “MobGe Games” (the “Games”) and to related websites and support (together, the “Services”).

By downloading, installing or using a Game, you agree to these Terms. If you do not agree, do not use the Services.

These Terms are also the end user license agreement (EULA) for the Games, including for any auto-renewable subscription offered in a Game.

Our Privacy Policy explains how we handle your information and forms part of these Terms.

If you live in a country with mandatory consumer protection laws, nothing in these Terms limits the rights those laws give you.

2. Eligibility

You must be at least 13 years old, or the minimum age required in your country, to use the Services. If you are under the age of majority where you live, a parent or legal guardian must review and accept these Terms, and must approve any purchases you make.

3. Your license to play

Subject to these Terms, MobGe grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to download, install and use the Games for your own non-commercial entertainment, on devices you own or control, as permitted by the rules of the app store you downloaded the Game from.

The Games are licensed to you, not sold. MobGe and its licensors keep all rights that are not expressly granted to you in these Terms.

4. Rules of conduct

When using the Services, you agree not to:

• copy, modify, distribute, sell or rent any part of the Games, or create derivative works from them;
• reverse engineer, decompile or disassemble the Games, or attempt to extract their source code, except where the law allows it;
• use cheats, bots, hacks, modified clients or any other unauthorized software that interferes with the Games;
• exploit bugs or errors, or obtain virtual items or currency through unauthorized methods;
• tamper with or fraudulently generate ad impressions, ad clicks, rewards or purchases;
• interfere with, disrupt or place an unreasonable load on our servers or networks;
• use the Services in violation of any applicable law.

If you break these rules, we may take action. This may include removing virtual items, resetting progress, or suspending or ending your access to the Services.

5. In-app purchases and virtual items

The Games are free to download. Some Games offer optional in-app purchases for virtual items, such as in-game currency, boosters, extra content, or an option to remove ads (“Virtual Items”). Some purchases may be subscriptions.

• Payment. All purchases are processed by Apple or Google under their terms. MobGe does not receive or store your payment details.
• License, not ownership. When you buy or earn a Virtual Item, you get a limited license to use it within the Game. Virtual Items have no monetary value, cannot be exchanged for real money, and cannot be transferred, sold or traded outside the Game.
• Refunds. Except where the law requires otherwise, all purchases are final. Refund requests are handled by Apple or Google under their refund policies. You can request a refund through Apple or Google Play.
• Right of withdrawal. If you are a consumer in the EU, the UK or Türkiye, you agree that delivery of digital content starts immediately after purchase. You also acknowledge that you lose your right of withdrawal once delivery begins, to the extent the law allows.
• Subscriptions. Subscriptions renew automatically unless you cancel them at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your App Store or Google Play account settings.
• Restoring purchases. You can restore non-consumable purchases, such as removing ads, through the “Restore Purchases” option in the Game (where available) using the same app store account. Consumable items, such as in-game currency, cannot be restored after you use them or if you uninstall the Game.
• Changes to Virtual Items. We may change, rebalance or stop offering Virtual Items. If we permanently shut down a Game, we will try to give reasonable notice. Except where the law requires otherwise, we are not required to give refunds for unused Virtual Items.

6. Advertising

The Games show ads provided by third parties, including optional rewarded ads that give you in-game rewards. Ads are provided by our advertising partners. We are not responsible for the content of third-party ads or the products they promote. For how ads use your information, see our Privacy Policy.

7. Game progress and cloud save

Your progress is usually stored on your device, and it may be lost if you delete the Game, reset or change your device. Some Games offer cloud save or platform save through Apple Game Center or Google Play Games. We do our best to keep these features working, but we do not guarantee that saved progress will always be available or can be restored.

8. Intellectual property

The Games and all related content, including code, artwork, characters, music, sound, text, logos and trademarks, are owned by MobGe or its licensors. They are protected by copyright, trademark and other laws. “MobGe”, the MobGe logo and our game titles are trademarks of MobGe. Nothing in these Terms gives you the right to use them, except as part of normal gameplay.

9. Feedback

If you send us ideas, suggestions or other feedback, we may use them freely, without any obligation or payment to you.

10. Third-party services

The Games may contain links to, or integrations with, third-party services, such as app stores, ad networks and platform game services. These services are governed by their own terms and privacy policies. MobGe is not responsible for them.

11. Updates and availability

We may update the Games from time to time to fix bugs, add or remove features, or change content. Some updates may be required to keep playing. We may also suspend or discontinue any Game or feature, temporarily or permanently. We do not guarantee that the Services will be available at all times or in every country.

12. Termination

You can stop using the Services at any time by uninstalling the Games. We may suspend or end your access to the Services if you break these Terms, if the law requires it, or if we discontinue a Game. When your access ends, your license to the Games and to any Virtual Items ends too.

Sections 5 (as it relates to refunds), 8, 9 and 13 to 17 continue to apply after termination.

13. Disclaimers

To the maximum extent permitted by law, the Services are provided “as is” and “as available”, without warranties of any kind, express or implied. This includes warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Some countries do not allow certain warranties to be excluded, so some of these exclusions may not apply to you.

14. Limitation of liability

To the maximum extent permitted by law:

• MobGe will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or Virtual Items, arising out of or related to the Services;
• MobGe's total liability for any claim related to the Services is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) USD 100.

These limits do not apply to liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, for fraud, or for gross negligence or willful misconduct.

15. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict of law rules. The courts and enforcement offices of Eskisehir, Türkiye, have jurisdiction over any dispute arising out of these Terms.

If you are a consumer, you also keep the protection of the mandatory laws of your country of residence, and you may bring a claim in the courts or before the consumer arbitration committees and dispute bodies available to you where you live.

16. App store terms

If you download a Game from the Apple App Store, the following also applies:

• These Terms are between you and MobGe only, not Apple. MobGe, not Apple, is solely responsible for the Game and its content.
• Apple has no obligation to provide maintenance or support for the Game.
• If the Game fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the Game.
• MobGe, not Apple, is responsible for addressing any claims relating to the Game, including product liability claims, claims that the Game fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
• MobGe, not Apple, is responsible for investigating, defending, settling and discharging any third-party claim that the Game infringes that third party's intellectual property rights.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms when using the Game.
• Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right to enforce them against you as a third-party beneficiary.

If you download a Game from Google Play, your use of the Game is also subject to the Google Play Terms of Service.

17. General

• Changes to these Terms. We may update these Terms from time to time. When we do, we will change the “Last updated” date above. If the changes are significant, we will give additional notice, for example in the Game. If you keep using the Services after the changes take effect, you accept the updated Terms.
• Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and MobGe about the Services.
• Severability. If any provision of these Terms is found unenforceable, the rest of the Terms remain in effect.
• No waiver. If we do not enforce a provision, that does not mean we waive our right to enforce it later.
• Assignment. You may not transfer your rights under these Terms. We may transfer ours, for example as part of a merger, acquisition or sale of assets.
• Language. These Terms are written in English. If they are translated, the English version prevails, except where the law requires otherwise.
